- The 2010 fiscal year’s visa bulletin is available at www.travel.state.gov. The employment 3rd preference category for professionals and skilled workers shows a priority date of June 2002.

- As of August 28, 2009, there remained approximately 20,000 H-1 cap subject petitions available for filing.

- The Department of Labor and Immigration are conducting random audits of companies employing persons holding H-1b visas.  Employers must keep a Public Access File (PAC) for each H-1b visa employee. The PAC should contain a copy of the Labor Condition Application filed with the Department of Labor, together with other documents stating the source for determining employee’s wages as well guarantees that the employer meets in order to employ such workers.

- The Immigration Customs Enforcement  (ICE) announced on August 18, 2009, that the agency will crackdown on employers suspected of hiring illegal workers.  Employers must comply with properly completing and keeping a file of employment-eligibility form I-9 for every employee.

- It is expected that a comprehensive immigration reform bill will be introduced in Congress this Fall.
